- Married with no children
- The surviving spouse inherits the entire estate.
- Married with child or children
- 1) If the deceased has no children from any other spouse, other than the one who survives that spouse, the entire estate goes to the surviving spouse.
2) If one of the decedent’s descendants is not also a descendant of the surviving spouse, the surviving spouse gets $50,000 plus one half of the estate balance. - Order of estate distribution if spouse survives
